Shingle Tomb™ – Terms & Conditions of Sale

1. General

These Terms and Conditions (“Terms”) govern all purchases of products from Shingle Tomb™ (“Company,” “we,” “us,” or “our”). By placing an order, the purchaser (“Customer,” “you”) agrees to be bound by these Terms.

2. Orders & Acceptance

• All orders are subject to acceptance by Shingle Tomb™.
• We reserve the right to refuse or cancel any order at our discretion.
• Orders are considered confirmed once payment has been received and/or written confirmation has been issued.

3. Pricing & Payment

• All prices are listed in USD unless otherwise stated.
• Pricing is subject to change without notice.
• Full payment is required prior to production unless otherwise agreed in writing.
• Applicable taxes, shipping, and handling fees are additional.

4. Custom Orders & Artwork

• Customers must provide vectorized logo files (SVG, AI, EPS) for custom printing.
• If vector files are not provided, a design/setup fee (e.g., $200 CAD) may apply.
• A digital proof will be provided for approval prior to production.
• Once approved, Shingle Tomb™ is not responsible for errors (spelling, colors, layout, etc.).

5. Production & Lead Times

• Production begins only after final proof approval and payment confirmation.
• Lead times are generally 2- 4 weeks and may vary due to demand, materials, or unforeseen delays.
• Shingle Tomb™ is not liable for delays outside of its control.

6. Shipping & Delivery

• Shipping costs are the responsibility of the Customer unless otherwise stated.
• Risk transfers to the Customer once products leave our facility.
• Shingle Tomb™ is not responsible for carrier delays, lost, or damaged shipments (claims must be filed with the carrier).

7. Returns & Refunds

• Custom products are non-refundable and non-returnable unless defective.
• Standard (non-custom) products may be returned within 14 days of delivery, subject to approval.
• Returned items must be unused and in original condition.
• Shipping costs are non-refundable.

8. Defects & Claims

• Customers must inspect all products upon delivery.
• Any defects, damages, or shortages must be reported within 5 business days.
• We reserve the right to repair, replace, or credit defective items at our discretion.

9. Intellectual Property

• All designs, branding, and product concepts related to Shingle Tomb™ remain the property of the Company.
• Customers confirm they have the right to use any logos or artwork provided.
• Shingle Tomb™ is not liable for copyright or trademark infringements related to customer-supplied materials.

10. Limitation of Liability

• Shingle Tomb™ shall not be liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount paid for the product.

11. Use of Product

• Shingle Tomb™ products are intended for marketing and storage purposes.
• The Company is not responsible for misuse or improper installation/use.

12. Order Cancellations

• Orders may only be canceled prior to production.
• Once production has started, orders cannot be canceled or refunded.

13. Force Majeure

• Shingle Tomb™ is not liable for delays or failure to perform due to events beyond its control, including but not limited to natural disasters, supply chain disruptions, or labor shortages.

14. Governing Law

• These Terms shall be governed by the laws of Kentucky, USA.

15. Updates to Terms

• Shingle Tomb™ reserves the right to update or modify these Terms at any time without prior notice.
